FITZPATRICK

 

The ancestor of the Franklin Fitzpatricks is the convict, John Fitzpatrick, born c.1806 in the parish of Rathdowney, Queen's Co. (now called Co. Laois, pron. 'leash') in Ireland. Rathdowney is located in the SW corner of Co. Laois.

 

John Fitzpatrick married Mary Clinch about 1830. Baptism records before 1838 from the Catholic parish of Rathdowney no longer exist which makes it impossible to find the dates of baptism for most of their children. The baptism record for the twins has survived. Rev. James Cody baptised Rody and Margaret Fitzpatrick 25 January 1842. At the time the family was living at Lyroge which is situated in the parish of Rathsaran, itself included within the geographical confines of the parish of Rathdowney. Rody's sponsors were Patrick McDonald and Judy Burdon. Margaret's sponsors were Michael Burdon and Suzie Clinch. This record allows us to find out the maiden name of John's wife, Clinch. Griffith's Valuation (1850) mentions the following surnames for the townland of Lyroge: Britt, Burdon, Cassin, Clinch, Deegan, Donnald, Hopkins, Keenehan, Pratt and Ryan. A James Clinch lived at Lyroge in 1850. He is most likely the father or brother of Mary.

John Fitzpatrick was tried at Queen's Co., 15 October 1845, for stealing two cows. He was sentenced to transportation for ten years. There is a short account of the trial in the Leinster Express, 18 October 1845: 'Queen's County Quarter Sessions. To be transported for ten years - John Fitzpatrick, for stealing two heifers from Mr. Samuel White at Raheenbeg.' John arrived in Hobart 25 August 1846 per the Lord Auckland which left Dublin 19 April 1846 with 180 male convicts on board.

 

 

The following description was taken down upon arrival: a Roman Catholic, could read and write, married, gaol report good, a farm labourer by trade, height five foot five and three quarters, aged 40, a fresh complexion, oval head, dark brown hair, brown whiskers, an oval visage, dark brown eyebrows, grey eyes, a medium nose and mouth, a broad double chin. He had a scar on the little finger of his left hand, a scar on the first and third fingers of his left hand, a scar on his left cheek and a scar on his knucles.

 

 

Brothers' names: Thomas, James, and Michael; sisters: Mary, Bridget, Catherine and Judith. John was put to labour for a period of 15 months working with a gang of convicts at Southport. (AOT CON 33/82, CON 18/48, CON 14/33).

Before receiving a ticket of leave, 22 October 1850, John Fitzpatrick made an application to bring his wife and children from Ireland to Australia. His application was dated June 1849. He stated that his wife's name was Mary and that he had 8 children: Catherine aged 18, Martin aged 15, Daniel aged 14, William aged 11, Ann aged 9, twins Rody and Margaret aged 7 and Eleanor aged 5. The names of two priests in Rathdowney were cited as references: Rev. James Cuddihy PP and Rev. Martin Cody. Rev. James Cuddihy was born in Blackwood, Lisdowney, received his earlier education in Burrell's Hall and was afterwards admitted to Maynooth for Humanity, August. 30th, 1819. After his ordination, at Pentecost, 1825, he was C.C. St. Mary's, from October, 1826, to January, 1831, and then Administrator of the same parish till April 1840, when he was collated to Rathdowney. He died in the house now occupied by Mr. Smith, The Square, Rathdowney, April 2nd, 1850, aged 51 years, and is buried in Rathdowney chapel. Rev. Martin Cody, son of Oliver Cody and Mary Purcell, was born in Kilmadimoge, Muckalee, in 1798. He studied in Burrell's Hail, entered Maynooth for Humanity, August 30th, 1819 and was ordained with his class-fellow and predecessor, at Pentecost, 1825. He was first on the mission in Birr, Diocese of Killaloe. His Curacies in Ossory were Danesfort in 1829, Mooncoin, Dunnamaggan, Freshford, and then Rathdowney from October, 1834 to 1850, when he was appointed P.P. of the Parish. He died June 6th, 1860, and is buried in the parish chapel.

 

Included in John Fitzpatrick's application was a reference from Mr. Loughman, an employer at O'Brien's Bridge, dated the 28 March 1849: 'John Fitzpatrick has been in my service since November 1847. I have found him without a single exception, to be a particularly sober steadfast hardworking man & he has been to me a very willing well-behaved trustworthy servant (I believe he has not been in any other private service). I therefore beg leave to recommend this his application to the favourable consideration of His Excellency The Lieutenant Governor.' (AOT MM 71/4, p.400). On 28 December 1849 the application was approved.

 

John Fitzpatrick continued to work for other free settlers in 1850. He was employed by James Murphy in New Town, 15 July 1850. He obtained his Ticket of Leave 22 October 1850. On 12 March 1851 he was convicted at Longford for misconduct and loitering about the township and sentenced to hard labour. On 14 September 1852 he was reported absent from a convict muster but accounted for on 5 October. He received a conditional pardon 14 December 1853.

 

John Fitzpatrick's wife and three of their children arrived in Hobart in January 1856 on board the Indian Queen. Mary's age was given as 46, Ann as 14, and the twins Margaret and Rody as 12. Daniel Ryan, aged 22, Ann Fitzpatrick's future husband, was on board the same ship.

Griffith's Valuation (1850) lists 71 Fitzpatricks as occupiers of land in the parish of Rathdowney. Fitzpatricks lived in the following townlands: Ballagharahin (4), Ballynakill (1), Barny & Bealady (2), Barrahill (1), Cappalinnan (2), Castlefleming (2), Clonburren (4), Clonmeen (3), Coolowley (3), Donaghmore (1), Errill (4), Johnstown Glebe (2), Kilcoke (2), Knockahaw (1), Knockardaghannon (5), Knockheel (2), Lisduff (2), Lismurragha (1), Monamonra (10), Rathdowney (12), Rathnaleugh (2) Rathpiper (3) and Tinnaclohy (1). Some of these 71 names refer to the same person. The Right Hon. John W. Fitzpatrick, is cited as occupier and owner 15 times. Most of the Fitzpatricks in the parish lived in Rathdowney or Monamonra.

 

Griffith's Valuation lists only one Thomas Fitzpatrick in the parish of Rathdowney. He occupied a house and land of 5 acres, 1 perch and 25 roods (block 4) in the townland of Ballynakill leased from Robert H. Stubber. The annual net value was £3 15/-.

There are two mentions of a Michael Fitzpatrick. It may be the same person. Michael and Patrick Meara leased land from Humphrey Palmer and others at Knockheel (block 10) just west of Rathdowney townland. It had an annual value of £13 5/-. A Michael leased a house, offices and garden from Joseph Palmer at 40 Chapel Street in Rathdowney, the main townland in the parish of the same name. The total value was £5 15/-.

There are two mentions of a James Fitzpatrick in the townland of Rathdowney itself. He leased a house and yard from William Hawksworth at 24 Shambles Street worth £1 a year.

There is one reference to a Mary Fitzpatrick in the townland of Rathdowney. This may be the wife of John. A Mary Fitzpatrick leased a house, yard and small garden at 13 Moore Street from Mrs Ellen Lyster with an annual value of 16/-. In the same street there lived a Margaret Fitzpatrick at Number 15, a Daniel Fitzpatrick at Number 27 and an Edward Fitzpatrick at Number 37.

Martin Fitzpatrick, the eldest son of John and Mary Fitzpatrick, married Bridget Wall, 27 September 1853 at Hobart. He was a baker at the time. The witnesses were William Bell and Bridget Hynes. Bridget Wall was born at Cappoquin, Co. Waterford, Ireland, c.1831. She was the daughter of Michael and Catherine Wall. Aged 19, she arrived in Sydney on board the Success 18 December 1849. Martin and Bridget Fitzpatrick settled in Franklin and had ten children three of whom died as young children.

 

Bridget had a brother, Thomas Wall, who was born c. 1825. Thomas married Honorah Dwyer in Franklin, 30 April 1857. He was tried in Co. Waterford 13 July 1850 and sentenced to 14 years' transportation for attacking the police barracks at Cappoquin. They had 12 children, including twins, 6 born in Franklin and 6 born in Port Cygnet where the family moved c.1870. Bridget Fitzpatrick was a sponsor for the baptism of Charles Wall in 1859 (the second child of Thomas and Honorah Wall). As well, Thomas Wall was a sponsor for the baptism of Catherine Fitzpatrick (1855) and Honorah Wall a sponsor for the baptism of Mary Ellen Fitzpatrick (1861). Thomas Wall died of gout at Port Cygnet, 25 August 1894, aged 69. Honorah Wall died at Cygnet 8 January 1936, aged 95.

Martin Fitzpatrick died at Franklin, 31 October 1901, of pneumonia and valve of the heart disease, aged 68. Bridget Fitzpatrick died at Franklin, 15 June 1908, of a cerebral haemorrhage, aged 76.

 

In his will, dated two days before his death, Martin Fitzpatrick appointed John Fitzpatrick and Daniel.C. Ryan as his trustees and executors. He bequeathed £300 to each of his sons (John, Martin and Thomas) and £150 to three of his daughters (Kate Daly, Mary Ellen Hill and Annie O’Beirne).

William Fitzpatrick, the second eldest son married twice. His first wife was Agnes Close (married at Franklin 7 May 1861). They had six children: James (b. 10 October 1862, baptised 31 August 1862 at Franklin, sponsors Martin Fitzpatrick and Hanora Wall), Catherine (b. 17 December 1863, baptised at Franklin 3 January 1864, sponsors William Dwyer and Anne Malone), Mary (b. 27 July 1865), a daughter (25 November 1869), a son (22 June 1871) and William Herriet (1875; died in Victoria in 1945). Agnes Fitzpatrick died at Franklin 6 September 1875 aged 31. Willam then married Margaret Gallagher, 25 February 1879. They had nine children: Katherine (b. 10 June 1880), Alice (b. 18 July 1881), Matthew (b. 21 June 1882), Ernest (b. 8 August 1883), Phyllis Maud (b. 22 April 1885), Ada Ethel (b. 4 December 1886), Ella May (b. 18 August 1888), Aileen (b. 24 October 1891) and Clyde (b. 19 December 1893).

Ann Fitzpatrick married Daniel Ryan at Franklin, 8 August 1859. They had eleven children:

The Last Will of Daniel Ryan (c. 1834-1902)

Be it known unto all men by the presents that on the twelfth day of May in the year of our Lord one thousand nine hundred and two the last Will and Testament of Daniel Ryan the elder late of Franklin Huon in Tasmania Orchardist deceased who died at Franklin aforesaid on or about the twenty first day of January one thousand nine hundred and two a true copy of which Will is hereunto annexed was exhibited and proved before this honorable Court and that administration of all and singular the goods chattels rights credits and effects of the said deceased within the State of Tasmania and the Dependencies thereof in the Commonwealth of Australia was and is hereby committed to Daniel Edward Ryan of Franklin aforesaid Orchardist and John Fitzpatrick of Franklin aforesaid Farmer formerly Captain of Steamship ‘Huon' the executors in the said Will named They the said Daniel Edward Ryan and John Fitzpatrick having been first sworn well and truly to perform the said Will by paying first the debts of the said deceased and then the legacies therein bequeathed so far as his estate shall hereunto extend and the law bind them And make and exhibit unto this Honorable Court a true and perfect Inventory of all and every the goods chattels rights credits and effects of the said deceased on or before the twelfth day of November now next ensuing And to render a just and true account of their executorship when they shall be lawfully called thereunto And further that they believe the goods chattels rights credits and effects of the said deceased at the time of his death did not exceed in value the sum of Ninety nine pounds in Tasmania and the Dependencies thereof under my hand and the seal of the Supreme Court of Tasmania this twenty seventyh day of May one thousand nine hundred and two.

 

This is the last Will and Testament of me Daniel Ryan the Elder of Franklin Huon in Tasmania Orchardist Whereof I appoint my son Daniel Edward Ryan and John Fitzpatrick of the same place lately Captain of the Steamship ‘Huon' to be Trustees and Executors of this my Will After payment of all my just debts funeral and testamentary expenses I give and bequeath all moneys which I might die possessed of unto and to the use of my wife Ann Ryan absolutely for her own use and benefit I give and bequeath the remainder of my personal estate including stock on my premises such as horses cattle and sheep also all implements utensils etc. in and around my house tanks etc. unto my Trustees Upon Trust for my said Wife during her life and after her death the same to go and belong to my two sons Martin Francis and William Hillery Ryan in equal shares I give and devise the whole of my real estate consisting of orchard and pasture land comprising in all ninety nine acres or thereabouts and situate at Franklin aforesaid together with the homestead in which I reside and all out buildings thereon erected unto my Trustees Upon trust for my said Wife for and during her life and after her death the same to go and belong to my said two sons Martin Francis and William Hillery Ryan in equal shares subject to the payment of Four hundred pounds each to each of my daughters as follows – namely – Catherine Ryan, Margaret Ryan and Mary Helen Ryan the said several sums of Four hundred pounds to be paid by equal annual payments of Fifty pounds to each of my said daughters until the said several sums of Four hundred pounds is paid off and I charge my real estate with such payments as aforesaid Should either or both of my said sons Martin Francis and William Hillery Ryan refuse or neglect to make such annual payments as aforesaid then the whole of my real estate shall be sold by my Trustees in such manner and at such a time as my Trustees may seem fit and the proceeds after deducting the expenses of such sale shall be divided equally amongst my said three daughters and my said sons Martin Francis and William Hillery Ryan I direct that the first annual payment as aforesaid shall be made within twelve months from the date of death of my said wife if she survives me and I further direct that my Trustees shall only sell the estate in case of refusal on my sons' part to pay the respective share to each of my said daughters as aforesaid should either of my said sons wish to sell his portion of the estate to the other of them he shall be at liberty to do so at a price to be agreed upon between them I direct that if in the opinion of my Trustees a bad season has happened rendering it impossible for my said sons to make such payment as aforesaid to each of my said daughters then time shall be given them such as in the opinion of my Trustees is fair and just but such annual payments as aforesaid must be strictly observed so far as is possible to do so I revoke all Wills heretofore made by me and declare this to be my true last Will and Testament In Witness whereof I have hereunto set my hand this sixth day of January one thousand nine hundred and two

Roderick (‘Rody’) Fitzpatrick married Mary Stanislaus Bleeze at Port Cygnet 26 June 1879. Mary was born in Cygnet 25 December 1858, the daughter of Charles Bleeze (born c.1834) and Bridget Madden/Maddon (born c.1830). They had eight children seven of whom survived:

Roderick Fitzpatrick signed his will 23 April 1924 at Newdegate St. Hobart. He appointed his wife, Mary Stanislaus Fitzpatrick as sole trustee and executrix. He bequeathed £250 to his daughter Mary Ignatius French of Launceston. Roderick Fitzpatrick died 10 June 1924. He was buried at Cornelian Bay.

Margaret Fitzpatrick married Frederick Herring at Franklin, 30 September 1874. They had six children:

Captain John Fitzpatrick married Mary Ann Wallace, 10 June 1879 at Hobart. There were five children: Ellen 'Elle' Mary Fitzpatrick b. 1 March 1881, married Harry John Dayton; Sarah Ann ‘Cissie’ Fitzpatrick, b. 24 Nov. 1882; died of appendicitis at the General Hospital, Hobart, 12 December 1906; William John Fitzpatrick, b. 3 Jan. 1885; Martin Herbert Fitzpatrick, b. 1 Feb. 1887 and Thomas Lawrence Fitzpatrick, b. 27 Oct. 1890.

Catherine ‘Kate’ Fitzpatrick married John ‘Jack’ Daly, 30 May 1879 at Hobart and had eight children: John Francis Daly, b. 13 Jan. 1879, (married Elsie Mary Rollins); Annie ‘Gertrude’ Daly, (born c. 1880) married Edward Fitzgerald Carroll; Sydney William Daly (born c. 1881) married Ella Maud Thorp; Sarah Stanislaus 'Floss' Daly, b. 25 Oct. 1882 (unmarried); Maud Theresa Daly, b. 30 Jan. 1884, (married Claude Henry Richardson); twins Thomas Patrick Daly (married Ethel Grimmond) and Martin Harold Daly, b. 14 Nov. 1885; and Mathew Daly (married Hilda May Muir). Kate Daly died 14 June 1934, aged 78. Buried at Cornelian Bay.

Sarah Fitzpatrick entered the Sisters of St. Joseph at Perthville in NSW, 4 May 1877, aged 17. She was the twenty-fourth woman to join the Josephite Sisters at Perthville (‘The Vale’), ten kilometres from Bathurst. Sarah joined following the missionary work of Father Julian Tenison Woods, co-founder of the Sisters of St Joseph, who was in Tasmania in the mid-1870s. She was the first Tasmanian to join the order. Soon after entering, Sarah, known as Sister Mary Stanislaus, was appointed to teach in the western regions of NSW. Her final profession took place 28 January 1886. She was appointed Mother General of the newly established diocese of Wilcannia Forbes. In 1891, Sister Stanislaus and Sister Ignatius Charters obtained permission from their bishop to take a holiday in Tasmania. At the invitation of the parish priest of Oatlands, Fr. Feehan, both sisters settled in Tunnack where they lived at St Brigid’s Convent and taught at the school. In 1893 the nuns joined the Tasmanian Josephites. After working in Tunnack, Sister Stanislaus taught in Westbury, Devonport, Lymington (12 years), Ulverstone, Richmond, Zeehan and Colebrook. She died at the convent in Cygnet, 6 September 1931, aged 71. A Requiem Mass was held in Cygnet on Monday, 7 September 1931, celebrated by Father James Ryan. Her remains were then brought on the same day to the Mother House at New Town where they were received by the Rev. P.J. Lynch. The following day, Tuesday, 8 September, a Solemn Requiem Mass was held for Sister Stanislaus at Sacred Heart Church, New Town. The Very Rev. Denis Murphy was celebrant. Present were her brother Martin Fitzpatrick, living in Geeveston, (Thomas, living in Franklin, was too ill to be present), and two sisters Kate Daly and Annie O’Beirne. Her niece, Mary Geer, was also present. Sister Stanislaus was buried at Cornelian Bay, Hobart.

Mary Ellen Fitzpatrick, aged 18, married Francis Brady Hill, aged 24, at Franklin, 27 February 1880 and had fifteen children, twelve of whom survived. She died at Geeveston, aged 53, 12 July 1915.

Annie Theresa Fitzpatrick married James O’Beirne at Franklin, 8 January 1890.
